General Purchase Conditions

Article 1: Applicability

1.1 These general purchase conditions apply to the entire provision of services Merford Acousticshop.eu (hereafter referred to as: "Acousticshop.eu"), established at Franklinweg 8, 4207 HZ Gorinchem.

1.2 The Merford Acousticshop.eu is part of Merford Noise Control B.V., established at Franklinweg 8, 4207 HZ Gorinchem, Chamber of Commerce No: 23041114, V.A.T No: 805021772B04.

1.3 By placing an order you automatically accept these conditions.

Article 2: Contract

2.1 The moment your internet order is completed a contract is made.

2.2 Merford reserves the right to dissolve the contract in special circumstances; for example when it is based on incorrect prices (from an input mistake or a mistake in the system - this does not apply to price increases) or when a product is no longer available (namely applies to articles with the reference GONE = GONE )

2.3 The client can dissolve the contract without incurring any costs and without stating any reason provided the item has not already been sent. When the item has indeed been sent, the conditions in article 6 apply. Therefore to cancel your order make telephone contact during office hours a.s.a.p.

Article 3: Prices

3.1 The previously mentioned prices for the products and services are stated in Euros, inclusive of V.A.T and exclusive of delivery changes.

3.2 The postage and packaging costs are calculated on-line on payment: so you know exactly how much the total cost will be. For orders over 100 within the Netherlands there are no delivery charges. For orders less than 100 Euro you pay a fixed rate of 4.95 Euro to reimburse these costs. Click here for an overview of the delivery costs to other countries.

3.3 The Acousticshop.eu reserves the right to alter these prices.

Article 4: Payment

4.1 You can pay online with your credit card (Mastercard / VISA).

4.2 You can also choose to collect the goods from the Acousticshop.eu during its opening times. In the Acousticshop.eu you may pay by PIN or cash. When you collect the goods no delivery charges apply.

4.3 In the exceptional case that a contract is dissolved and you have still paid for the order this sum will be returned a.s.a.p. (and definitely within 30 days).

Article 5: Delivery

5.1 Almost all items in our assortment are stock articles. Your order will be sent usually 2 working days and definitely within 5 working days after payment.

5.2 Occasionally a stock article may be temporarily sold out. In that case we will contact you either by telephone or e-mail to inform you about the delivery time. If you consider the delivery time is too long you may, of course, dissolve the contract without incurring any costs (see also returns and cancellation conditions).

5.3 Some products are tailor-made. These non-stock articles do not have a standard delivery time. This concerns the following products:

Article 6: Return and cancellation conditions

6.1 With the exception of special tailor-made manufactured products (such as our acoustic paintings) there is a 7 working day cancellation period for every order from the Acousticshop.eu. Within this period you may rescind the contract with the Acousticshop.eu without paying any penalty or stating any reason; provided the goods are returned in their original condition. In this case you pay only the costs for returning the goods. After the receipt of the returned good, your money will be refunded as soon as possible (at the latest within 30 days).

6.2 The period of the right of rescindence starts on the day which you receive your goods. When you rescind the contract you must contact the Acousticshop.eu by telephone or e-mail. We will then inform you how the goods can best be returned.

6.3 When you do not accept an order, then it is automatically sent back. The costs for the return can be recovered from the purchaser by the Acousticshop.eu.

Article 7: Ordering / Communication

7.1 The Acousticshop.eu is not responsible for delays or the improper receipt of orders as a result of the use of internet or any other means of communication in the contact between you and the Acousticshop.eu, except in the case of deliberate or serious fault.

Article 8: Act of God

8.1 In the case of an Act of God the Acousticshop.eu has the right, at its own free choice, to suspend or dissolve the carrying out of your order. By Act of God, we understand every shortcoming which cannot be attributed to the Acousticshop.eu because it cannot be held responsible for the fault nor according to the law incurs any expenses from any legal measure or misunderstanding.

Article 9: Various

9.1 The measurements of our plate materials can vary in practice. However provided these measurements are better than expected in practice, a tolerance of approximately 10% applies to our products.

Article 10: Guarantee Provisions

10.1 For all articles of our assortment for which you can reasonably expect along lifespan, you get a six month guarantee against defects or manufacturing faults. Your invoice (which you receive directly after your order by e-mail) is the proof of the guarantee.

Article 11: Complaints/ Resolution of Differences

11.1 If you are dissatisfied with the service provision of the Merford Acousticshop.eu (and you cannot resolve this with the employees of the Acousticshop.eu) then you can yourself contact the Commission for Resolution of Disputes in writing:

Do not forget to state your order number and your address details in your letter. You will receive a written response within two weeks at the latest.

Article 12: Responsibility

12.1 Merford Acousticshop.eu gives the best possible advice, based on your description. In practice that can prevent acoustic interference. Merford Acousticshop.eu can not be held responsible for acoustic interference because it is highly dependent on the initial structural conditions: contact noise and/or noise from other sources (noise which Merford Acousticshop.eu has no knowledge of) can influence the final result. In the case of acoustic interference, do contact us! We will be pleased to provide you with further information in order to improve the acoustic results.

12.2 As you are also responsible for the manner in which you install and/or apply our products, Merford and/or the Acousticshop.eu can also not be held responsible for possible costs arising as a result of the use of our products; also even when these are applied as described in the product description and/or on our website. For extra insurance with complex programs use an acoustic advisor; who will be present on location to assess the situation and give you suitable advice.

Article 13: Applicable Law and the Competent Court

13.1 The entire provision of services of Merford Acousticshop.eu. is exclusively subject to Dutch Law

13.2 All differences between parties will be exclusively brought before the competent Dutch Court.
